California – A 33-year-old San Francisco man faces criminal charges following an alleged sexual assault involving a woman attending wedding celebrations in Minnesota. The case raises concerns about consent, alcohol-related incapacitation, and the safety of individuals attending social gatherings.
San Francisco Man Faces Sexual Assault Charges Following Minneapolis Bar Incident
Antony Sun Liwanag, 33, faces two counts of third-degree criminal sexual conduct in Hennepin County following an alleged July 2 incident.
According to charging documents, the woman attended a pre-wedding gathering before accompanying Liwanag, her co-worker, to another bar in Minneapolis. After consuming alcohol, she reportedly became unusually impaired and suspected her drink had been tampered with.
She alleged that Liwanag kissed and touched her without consent despite her objections.
Prosecutors stated that surveillance footage later showed Liwanag carrying and dragging the visibly impaired woman through a St. Louis Park hotel. She also reported resisting another alleged assault inside her room.
The woman returned home the following day, missing the wedding. Authorities requested an arrest warrant, citing public safety concerns. The allegations remain unproven.
How California Law Protects Sexual Assault Survivors
Although the alleged incident occurred in Minnesota, California law provides important protections for sexual assault survivors seeking civil justice.
Under California Civil Code Section 1708.5, survivors may pursue civil claims involving nonconsensual sexual contact.
Potential legal protections include:
- Consent: Intoxication or incapacitation may affect an individual’s ability to provide legally valid consent.
- Civil compensation: Eligible survivors may seek damages for medical expenses, emotional distress, and other documented harm.
- Filing deadlines: California Code of Civil Procedure Section 340.16 generally allows qualifying adult survivors 10 years from the assault or three years from discovering a related injury, whichever is later.
- Independent claims: Civil proceedings do not necessarily require a criminal conviction.
These protections concern California claims. Incidents occurring elsewhere may be governed by another state’s laws.
