Sexual Assault Charges Filed After San Francisco Incident

San Francisco, California — A 36-year-old man has been charged in connection with an alleged sexual assault involving a 21-year-old woman in San Francisco’s Bayview District. Prosecutors say the woman was unconscious when the alleged assault began and reported that she was unable to consent.

San Francisco Prosecutors File Charges Following Bayview Incident

The alleged incident occurred on September 26, 2026, near Bayshore Boulevard and Industrial Street. According to the San Francisco District Attorney’s Office, the woman reported waking inside a tent while David Vonstetten was allegedly sexually assaulting her.

Prosecutors said the two did not know each other before the incident. The woman reportedly left the tent, went down the hill, and found a witness who helped her contact the police.

Responding officers located Vonstetten and took him into custody, while the woman received medical treatment at the scene.

Prosecutors announced charges on October 7, including sodomy involving an unconscious or intoxicated person, sodomy by force, sexual battery by restraint, and felony false imprisonment. The investigation remains active, and the charges are allegations unless proven in court.

California law recognizes criminal offenses involving sexual activity when a person is unconscious, intoxicated to the point of being unable to consent, subjected to force, or restrained. The charges filed in this case include offenses under Penal Code Sections 286, 243.4, and 236.
