How California Law Addresses Human Trafficking Crimes

Under California Penal Code §236.1, human trafficking is defined as the act of depriving another person of their liberty with the intent to obtain forced labor, services, or commercial sexual acts. Consent is not a defense in cases involving minors, and penalties are significantly enhanced.

Victims of human trafficking may pursue both criminal justice and civil remedies, including compensation for damages such as:

  • Emotional trauma and psychological harm
  • Lost wages and future earning capacity
  • Medical and counseling expenses
  • Punitive damages for egregious misconduct

California also provides specialized victim support programs, including safe housing and legal advocacy for survivors of exploitation.
